Good news for the sports car drivers!  My guess is that it won’t take long for this case to lead to a finding that Cops can’t stop drivers based on the make of their car either.  So that Red Mustang won’t be quite as likely to get you pulled over 🙂  **DB

 

Court: Cops can’t Stop Drivers Based on the Color of their Cars

“Probable cause” has long been one of those terms that made the jump from legal jargon to household term, especially with regards to drivers who get pulled over. The struggle over what that allows on American roads — and what it doesn’t — took a new turn last week with a Florida ruling that threw out a conviction stemming from a police officer who found something wrong with the color of a car.

In 2010, a deputy in Florida’s Escambia County saw one Kendrick Van Teamer drive by in a bright green Chevrolet. The deputy ran his plates, and found the registration matched a blue Chevrolet. There were no warrants out for Teamer, no reports of stolen vehicles and no pending crimes that involved either a blue or green Chevy. Teamer also wasn’t violating any traffic laws.

But the deputy pulled Teamer over anyway, simply because of the mismatch of the car’s color. Teamer said the car had been recently painted, which was true. It also contained small amounts of cocaine, marijuana and $1,100 in cash. Teamer was charged with drug trafficking and possession, convicted and sentenced to six years in prison.

Teamer appealed, and last week as noted by The Newspaper, the Florida Supreme Court ordered him freed on a 5-2 decision, upholding a lower appeals court ruling that the deputy was wrong to stop Teamer simply becuase the color of his car didn’t match its registration. The court noted that in numerous U.S. Supreme Court rulings, justices have found police can’t pull someone over for everday behavior that’s not linked to a crime, saying Teamer’s stop was not different from those triggered by the race of the driver: . . . .

May the world never lose sight or forget this shining moment in United States and the world’s history, and the faith of a few brave men that laid the way for a new voice for freedom.  The Fourth of July is one of our greatest moments in history, perhaps our proudest and most shining.  We remember this holiday as the moment celebrating our nation’s freedom from the control of tyrants and a distant empire.

The fourth of July was the day that a group of brave, determined men rose and told the British Empire’s King George that the Americans were not second class citizens.  They declared that this land was not merely the property of far-away landowners, to be used and abused by rulers who had never even seen the shores. They announced to the world that America was a great place in and of itself, not merely an extension of England.   They declared that this fact gave them the right to have a voice in their future, regardless of whether they were European or high society by birth.  Then in turn, they used this voice to demand the right to have a say in their own government, the right to decide what happened within their borders, and the right to stake their own, independent claim on the land they had worked for and loved so dearly.   They reminded King George and his parliament of the English’s own Magna Carta and the freedoms it entailed. And then they enforced those rights.  They threw off their imperial yoke and proved once and for all that this land was independent. That it was strong. That it’s people were willing to fight and die for it. And that it wasn’t going anywhere, at least not for a very long time.

Not only did they prove their mettle to England, they also reminded the world that ancient empires, blue blood, and advanced armies were not guaranteed a victory. That sometimes a group of rustic, common, poorly armed men and women can win too.  That sometimes it is a passion in your battle and knowledge of what you stand to lose that makes the difference.  That those facing the greater cost have an extraordinary will-power and the ability to survive just about anything.  It’s just a matter of believing in your cause so much, nothing else matters in the end ~ food, clothing, the comforts of home, even the most basic needs – all can be set aside in the name of this cause. With that much determination, it is amazing what you can do.

And so to honor this great stride for freedom and human independent rights, we salute you, the soldiers of the American War of Independence.  You who put everything on the line in the name of your home, your family, your friends, and your land.  We thank you for giving us the one chance in a million, for believing in humanity enough to give your citizens a voice.  For having enough faith in the little guy to rise up and make yourself heard.  And in your name, we still say “God Bless America.” 

 

Random Lit. Crit. Question ~ The Sleeping Beauty Fairies

Random Question:

Have you every wondered what Aurora (Sleeping Beauty) would have been like had the fairies not given their birthday presents? Would she have been ugly, stupid, a horrible singer, nonspiritual, ungraceful, unmusical, and unhappy? Or were a couple of those wishes wasted on her? I suddenly had this mental image of wondering how she changed after their wishes. Was she a bald baby that suddenly grew a full head of hair? Were her teething cries suddenly full-on choreographed musical numbers? What was the REAL Aurora like?

Were these changes really any good for her?  Perhaps she would not have married Philip and enchanted the birds, but did she suddenly lose her original soulmate by no longer being likely to stumble into his path?  Or would Philip have fallen for her anyway?  Does this mean that Philip was really more shallow than we thought, if he needed a perfect princess to fall in love?  I mean, it’s no wonder he fell at first musical chord.  And if she lost her first soulmate (the one who loved the original her), does this mean she stole Philip’s soulmate?  The one that was made for him before the fairies changed Aurora’s life?

Other than saving her life, how did they change her future? And did her mother miss the original Aurora? Taking the story way too seriously, but that’s what you get with an English major. 🙂

Weekly Rant ~ The Value of Human Lives

Human lives are NOT commodities. They are not objects to be tossed aside, to be massacred, or to be played off against one another. They are not slaves, sex toys, or punching bags. These are LIVES. . . emotions, experiences, memories, passions, fire and hope and amazement. If I hear of one more senseless slaughter, one more mutilated woman, one more bullied kid, one more teen suicide, one more child abuse case, or one more sex ring news article, I think I might just sit down and weep. When will people realize how important we all are? When will they stop thinking about themselves and their self-gratification and their need for power, popularity, swag, control, and money long enough to realize what they are destroying? Where is our humanity? Sorry, but I just skimmed the news headlines. Depressing, so very depressing.

Reckless Flying

Stupid hit and run flies. There I am sitting at a perfect stop at the red light, when out of nowhere this huge fly slams face first into my windshield. I totally had damages from the shock. But does he face up to his stupidity? Oh no, he just shakes it off, gets up, and RUNS AWAY! Can you believe it? The nerve.

Get Excited! New Fees from the legal Basic Skills Course!

(For those of you unfamiliar with the process, law students in Iowa have to take a “Basic Skills” course their first year that covers everything they were just tested on for the bar exam.)

Now, on with the show.

Just received an email that started off really exciting, with lots of exclamation points:

“This Year’s Annual Meeting and Basic Skills Course are going paperless!” (Bold red font straight from the email).

Naturally, you start going Woohoo! we’re helping the environment.  I’m all about this!

But then they go on. . . 

“It is strongly suggested attendees print off the materials in advance of the event.”  (Lack of bold red print fresh from the email).

Oh.  So not helping the environment, just shifting the printing costs onto the obviously poor new lawyers that just graduated from a college degree that permits students to take no jobs.  Students who paid a couple thousand dollars for a bar exam that didn’t cost that much to administer. As opposed to the bar association and supreme court that arranges and requires the multiple day event involved lots of paperwork.  Organizations who have plenty of money due to us paying for a bar exam that didn’t cost that much to administer.  

Now, before our first job arrives, we need to pay for:

  • The Event ($100+)
  • The Hotel ($100+)
  • The Transportation ($100+)
  • Food (min $20+)
  • and Printing (One document for one event ~ there are several each day of four days ~ was 80+pages.) 

Sorry,  this “Breaking, Exciting News” press release was an epic fail.  Not seeing the excitement this message acted like it was supposed to incite.
